Memorandum of Intent
What is a Memorandum of Intent?
A Memorandum of Intent is a personal letter from you to the people who will care for your child when you no longer can. It supplements your estate plan by providing information that is not appropriate to include in your special needs trust because that information changes over time, is your wish but not a legal requirement, or is too lengthy to include in the trust.
How do I use it?

- In the left-hand corner of the document choose "File" and then "Save as."
- In the field that says "Save in" choose Desktop and click "Save".
- You can type directly into the fields provided in the Memorandum of Intent.
- Make sure to click "Save" when you are finished entering text into the document.
Start the MOI by filling out the easiest parts; those that you have the answers to right now. Then, over time, add to the MOI bit by bit. Make sure that your attorney always has a copy of your latest version so that it can be easily located when needed.
How does my attorney use it?
Your attorney will keep a copy in your file and, when the need arises, share that document with your child's caregivers and trustee(s). The document will be used to interpret your trust and to ensure your child gets the most personalized responsible care and therapies possible.
